National Interest Waiver

Foreign nationals seeking to immigrate to the United States may obtain a waiver of a job-offer requirement if the Department of Homeland Security deems that their immigration will be in the national interest. 

To qualify for the national interest waiver, the foreign national must show that he seeks to work in an area of substantial intrinsic merit, that his proposed activity will be national in scope, and that he will serve the national interest to a substantially greater degree than would an available U.S. worker having the same minimum qualifications.  To demonstrate the last factor, the foreign national must show a track record of success with a degree of influence on the field as a whole.  The Department of Homeland Security can approve the petition if it decides that the employment of the foreign national will make a greater difference that is national in scope in comparison to the employment a fairly competent U.S. worker.
